Terms of Use

1. Agreement and eligibility

By using Kinetic, you agree to these terms and the Privacy Policy. If you do not agree, do not use Kinetic. You must be legally able to enter this agreement where you live. If you use Kinetic for someone else or an organization, you confirm that you have authority to accept these terms for them.

2. The Kinetic service

Kinetic helps you plan, record, and understand exercise and fitness activity. Features may include workout tracking, routes, Apple Health integration, on-device intelligent features, training insights, device synchronization, widgets, and Live Activities. Features may change, be added, or be removed as the product develops.

Beta or TestFlight versions may be incomplete, change without notice, and contain errors. Do not rely on beta software as your only record of important information.

3. Fitness and medical disclaimer

Exercise involves risk. You are responsible for deciding whether an activity, workout, route, intensity, or recommendation is appropriate for you. Consult a healthcare professional before starting or changing an exercise program, especially if you have a medical condition, are pregnant, take medication, or have symptoms or concerns. Stop exercising and seek appropriate help if you feel pain, dizziness, shortness of breath, or other concerning symptoms. In an emergency, contact local emergency services.

Health, location, sensor, calorie, pace, route, recovery, score, and performance estimates may be delayed, incomplete, or inaccurate. Do not use Kinetic for emergency response, navigation where safety depends on precise directions, or medical decisions.

4. Your account and data

You are responsible for safeguarding your device and account credentials and for activity under your account. Provide accurate information, tell us promptly about suspected unauthorized access, and keep a separate copy of information you cannot afford to lose.

You retain ownership of workout plans, notes, routes, and other content you provide. You grant Rokuru a limited, non-exclusive license to host, process, reproduce, and transmit that content only as needed to operate, secure, support, and improve Kinetic. You may delete your account through the in-app flow described on the Support page.

5. Permissions and third-party services

Some features require permissions or third-party services such as Apple HealthKit, location services, Sign in with Apple, Google Sign-In, Firebase, MapKit, Apple Watch, or App Store services. Your use of those services is also subject to their terms. Kinetic cannot guarantee their availability, accuracy, or continued compatibility.

6. Acceptable use

You may not misuse Kinetic. In particular, you must not:

• break applicable law or infringe another person’s rights;
• attempt unauthorized access, probe security, disrupt the service, or introduce malicious code;
• reverse engineer or circumvent technical restrictions except where applicable law expressly permits it;
• use automated means to overload, scrape, or abuse Kinetic; or
• submit unlawful, harmful, or infringing content.

We may restrict or suspend access when reasonably necessary to protect users, the service, or comply with law.

7. Kinetic ownership and license

Rokuru and its licensors own Kinetic, including its software, design, branding, documentation, and other content, excluding content you provide. Subject to these terms, Rokuru grants you a limited, personal, revocable, non-exclusive, non-transferable license to use Kinetic for its intended purpose on supported devices.

8. Availability and changes

We aim to keep Kinetic useful and available but do not promise uninterrupted or error-free service. Maintenance, outages, network conditions, device limitations, third-party changes, or events outside our control may affect availability. We may update, suspend, or discontinue a feature or the service, with reasonable notice when practical.

9. Warranties and liability

To the fullest extent allowed by law, Kinetic is provided “as is” and “as available,” without warranties beyond those that cannot legally be excluded. Rokuru is not responsible for indirect, incidental, special, or consequential loss, lost data, lost profits, or injury resulting from unsafe exercise choices, except where liability cannot be limited under applicable law.

Nothing in these terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that applicable law does not permit us to exclude. Mandatory consumer rights remain unaffected.

10. Ending use

You may stop using Kinetic at any time and may delete your account in the app. We may suspend or terminate access if you materially breach these terms, create security or legal risk, or misuse the service. Provisions that by their nature should survive—such as ownership, disclaimers, and liability limits—continue after termination.

11. Governing law and disputes

These terms are governed by Norwegian law, without regard to conflict-of-law rules. Disputes should first be raised with support@kineticfit.ai so we can try to resolve them informally. Subject to mandatory consumer protections, disputes are submitted to the courts of Norway.

If you are a consumer, this choice of law and forum does not deprive you of protections or courts available under mandatory law in your country of residence.

12. Changes and contact

We may update these terms to reflect product, legal, or operational changes. We will post the revised terms here, update the effective date, and provide additional notice when a change is material. Questions can be sent to support@kineticfit.ai.
